Terms of Service

1. Acceptance of Terms
By accessing or using CardComm ("the Service", "the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
2. Description of Service
CardComm is a platform that enables Australian Football League (AFL) card collectors to:
- Showcase their card collections
- Search for cards owned by other collectors
- Propose and negotiate trades with other users
- Arrange real-world card exchanges
- Rate and review completed trades
2.1 Geographic Restrictions
The Service is currently intended for users located in Australia only. By using the Platform, you confirm that you are located in Australia. Shipping and trading services are designed for domestic Australian transactions. We reserve the right to restrict or terminate access for users located outside of Australia.
3. User Accounts
3.1 Account Creation
You must create an account to use most features of the Platform. You agree to provide accurate, current, and complete information during registration and to update it as necessary.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.
3.3 Age Requirement
You must be at least 13 years old to use CardComm. Users under 18 should have parental or guardian permission.
4. User Conduct
You agree NOT to:
- Upload false or misleading information about cards
- Misrepresent card condition, authenticity, or ownership
- Engage in fraudulent trading practices
- Harass, threaten, or abuse other users
- Use the Platform for any illegal purpose
- Upload content that infringes on intellectual property rights
- Attempt to gain unauthorized access to the Platform or other users' accounts
- Use automated tools to scrape or collect data from the Platform
5. Trading Terms
5.1 Platform Role
CardComm is a facilitator that connects collectors. We do not participate in trades, take possession of cards, or guarantee the quality, safety, or legality of any cards traded.
5.2 User Responsibility
All trades are agreements between individual users. You are solely responsible for:
- Accurately describing your cards
- Ensuring cards are authentic and legally owned
- Packaging and shipping cards securely
- Providing accurate shipping information
- Communicating with trade partners
- Resolving disputes directly with trade partners
5.3 Shipping and Delivery
Users are responsible for all shipping costs and arrangements. We recommend using tracked shipping methods. CardComm is not responsible for lost, damaged, or delayed shipments.
5.4 Trade Obligations and Enforcement
Once a trade is agreed upon, both parties are expected to fulfill their obligations by:
- Sending the agreed cards within a reasonable timeframe
- Uploading tracking numbers or proof of postage to the Platform
- Using appropriate packaging to protect cards during transit
- Communicating promptly about any issues or delays
Consequences of Non-Compliance: Users who fail to send cards as agreed or who do not provide tracking numbers or proof of postage may face account restrictions or permanent bans from the Platform. We take trade integrity seriously and will investigate reports of unfulfilled trades. Repeat offenders or users engaging in fraudulent behavior will be permanently banned without prior notice.
5.5 Disputes
If a dispute arises between trade partners, users should attempt to resolve it directly. CardComm may provide dispute information but is not obligated to mediate or resolve disputes.
6. Content and Intellectual Property
6.1 User Content
You retain ownership of content you upload (card photos, descriptions, etc.). By uploading content, you grant CardComm a non-exclusive, worldwide license to use, display, and distribute your content on the Platform.
6.2 Platform Content
The Platform design, features, and functionality are owned by CardComm and are protected by intellectual property laws. You may not copy, modify, or distribute any part of the Platform without permission.
6.3 Third-Party Content
AFL team names, logos, and player names are trademarks of their respective owners. CardComm is not affiliated with or endorsed by the AFL or any AFL clubs.
7. Ratings and Reviews
Users may rate and review trade partners after completing trades. Reviews must be honest and based on actual experiences. We reserve the right to remove reviews that violate these Terms or are abusive, false, or misleading.
8. Termination
We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or other reasons we deem appropriate. You may delete your account at any time through the Platform settings.
Upon termination, your right to use the Platform ceases immediately. Active trades may need to be completed before account deletion.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
CardComm disclaims all warranties, express or implied, including:
- Warranties of merchantability or fitness for a particular purpose
- That the Service will be uninterrupted, secure, or error-free
- That the quality of cards traded will meet your expectations
- That other users will fulfill their trade obligations
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARDCOMM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use or inability to use the Service
- Failed trades or disputes between users
- Lost, damaged, or counterfeit cards
- Unauthorized access to your account
- Any conduct or content of third parties on the Service
11. Indemnification
You agree to indemnify and hold harmless CardComm from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.
13. Governing Law
These Terms are governed by the laws of Australia. Any disputes arising from these Terms or use of the Service shall be subject to the exclusive jurisdiction of the courts of Australia.
